You need to speak with members of the Tribal Council who were in the session with HUD Officials when the problem of procurement was explained and discussed. The matter of procurement without public bidding in excess of $100,000 violates the federal procurement policy. According to the August, 2003 minutes, the Housing Director and the Attorney advised the Tribe that they could procure 30 mobile homes (they actually wanted 60 but stayed within $250,00) which exceeded tribal NAHASDA procurement policy of $100,000 and violate NAHASDA procurement policies for public bidding. Quotes were utilized and the recommendation made and passed. At no time from October 2000 until December 2001 did I ever approve or accept a recommendation to procure mobile homes in large numbers. Mobile homes were utilized only for rehabilitation for replacement when rehabilitation costs would exceed the approved $15,000 up to $20,000 and on a case by case basis and public bidding was not needed since we were not ordering mobile homes in masse. Again, NAHASA policies are public records in the Tribal Office and copies should be made available upon request. It would be well for anyone with any questions to obtain copies so that they can become well informed about the policies while monitoring the actions of the people's government. I would again refer you to the minutes of the Tribal Council for further documentation of action by the Council.
